Your Agreement With Social Media Guru

Since 2019, Social Media Guru has provided expert social media management to over 10,000 brands. You retain full ownership of your content while benefiting from our professional services.

By using our services, you acknowledge and agree to the following terms.

1. Definitions

  • “We,” “us,” or “our” refers to Smarcomms Services LLP.
  • “Client,” “you,” or “your” means any individual or business that purchases our services.
  • “Services” include all digital marketing, social media management, and related offerings provided by Smarcomms.

2. General Terms

  • Our services are subject to these terms and may be updated at any time.
  • Any modifications will be communicated via email or our website.
  • Continuing to use our services after updates means you accept the changes.

3. Service Delivery

  • We provide social media management, content creation, and other marketing services.
  • Delivery timelines depend on the agreed-upon service package.
  • Clients must provide accurate and timely information to facilitate service completion.

4. Payments

  • Service fees are outlined in the order confirmation or contract.
  • Payments must be made in advance unless otherwise agreed in writing.
  • Monthly subscription services require payment upon invoice receipt.

5. Refund Policy

  • Social Media Management Services: Refunds are available within 14 days of the first published post.
  • If a draft post is neither approved nor rejected within 14 days, it is considered accepted, and no refund is available.
  • Clients cannot postpone approvals indefinitely to manipulate refund policies.
  • Other Services: Refunds for consulting or one-time content creation are only available within 14 days of signup.
  • Non-Refundable Fees: Setup, onboarding, and consulting fees are non-refundable.
  • No refunds will be issued for partially completed subscription periods.
  • Chargebacks & Disputes: Clients must contact us before initiating chargebacks. We may terminate services for clients who file chargebacks without prior discussion.

  • You must provide necessary approvals, materials, and feedback in a timely manner.
  • Service delays caused by the client do not qualify for refunds or extensions.

7. Service Limitations & Cancellation

  • Clients can cancel subscriptions at any time with no prior notice.
  • Refunds are not issued for partial subscription periods, except as outlined in the refund policy.
  • We reserve the right to terminate services if a client violates these terms, fails to provide required input, or engages in inappropriate behavior.

8. Intellectual Property

  • Social Media Guru retains ownership of all created content until full payment is received.
  • Once payment is completed, clients receive a non-exclusive license to use the content.

9. Confidentiality

  • Both parties must keep all non-public information exchanged during service confidential.

10. Liability Disclaimer

  • Social Media Guru is not responsible for indirect, incidental, or consequential damages arising from service use.
  • Our liability is limited to the total amount paid for the service in question.

11. Governing Law & Disputes

  • These terms are governed by USA law, and disputes will be handled in USA courts.

12. Privacy & Data Protection

  • By using our services, you agree to our data collection and processing as outlined in our Privacy Policy.
  • Social Media Guru complies with all USA Privacy and Data Protection regulations.

13. Indemnification

  • You agree to protect Social Media Guru and its employees from any claims, damages, or liabilities resulting from your use of our services or violation of these terms.

14. Force Majeure

  • Social Media Guru is not liable for service delays or failures caused by events beyond our control, such as natural disasters, cyberattacks, or government actions.

15. Third-Party Tools

  • Some of our services rely on third-party platforms, and we are not responsible for their availability or functionality.

16. No Guaranteed Results

  • While we implement best practices, we do not guarantee specific increases in followers, engagement, or sales, as these factors depend on various external influences.

17. Reputation Protection

  • Clients agree not to make negative public statements about Social Media Guru. Any disputes should be handled professionally and privately.

18. Subscription Renewals & Cancellation

  • Subscriptions automatically renew monthly unless canceled before the next billing cycle.
  • Clients can cancel via their account portal or by contacting support@social-media.guru.

19. No Affiliation With Social Platforms

  • Social Media Guru is an independent service provider and is not officially connected with Facebook, Instagram, X (Twitter), LinkedIn, Pinterest, Google Business, TikTok, or YouTube.
  • Any references to these platforms are for descriptive purposes only.
